Terms and Conditions
Overview of our terms and conditions.
1. Scope
These general terms and conditions apply to all contracts between Kitaly, Lorena Surdi (hereinafter "Kitaly"), and contract partners (daycare centers, operators, parents) regarding food delivery and use of the digital platform.
2. Subject of the contract
Kitaly provides daily delivery of warm, freshly prepared meals to daycare centers as well as a digital platform for meal planning, allergies, attendance, and orders.
3. Contract conclusion
The contract is concluded upon written confirmation of an offer by Kitaly. The minimum contract term is 6 months. Early termination is only possible for an important reason.
4. Prices and payment
Prices are set according to the current price list. Invoicing is done monthly after the service is delivered. The payment term is 14 days after receipt of invoice. All prices include statutory value-added tax.
5. Delivery
Delivery takes place daily at the agreed times to the daycare center. Receipt of delivery must be confirmed by the center. In case of absence, the center must notify via platform or phone at least one business day in advance.
6. Allergies and special diets
Kitaly is responsible for correctly preparing allergen-safe meals based on information stored in the platform. The daycare center and/or parents must keep information about allergies, intolerances and specific nutritional needs up to date at all times.
7. Liability
Kitaly is liable for material and personal damages only in cases of intent or gross negligence. Liability for ordinary negligence is limited to breaches of essential contractual obligations. Liability for indirect or consequential damages is excluded where permitted by law.
8. Data protection
Personal data processing is carried out in accordance with our Privacy policy and applicable data protection regulations (GDPR). For use of the digital platform, the platform terms of use also apply.
9. Termination
After the minimum contract term has expired, the contract may be terminated with three months' notice to the end of a month. Termination must be in writing or can be completed through the digital platform.
10. Final provisions
Any changes to these terms must be made in writing. If any provision of these terms is or becomes invalid, this does not affect the validity of the remaining provisions. German law applies. Jurisdiction is Ludwigshafen am Rhein, where legally permissible.
